NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-280/95-06 AND 50-281/95-06)

Gentlemen:

This refers to the inspection conducted by M. Branch of this office on March 5

through April 1, 1995.

The inspection included a review of activities

authorized for your Surry facility. At the conclusion of the inspection, the

findings were discussed with those members of your staff. The report

documenting this inspection was sent to you by letter dated April 14, 1995 .

NRC concerns relative to the inspection findings were also discussed in an

Enforcement Conference held on April 24, 1995. A summary of this Enforcement

Conference was sent to you on May 5, 1995.

Based on the results of the inspection and additional information you provided

at the Enforcement Conference, we have concluded that certain of your

activities are in violation of NRC requirements, as specified in the enclosed

Notice of Violation (Notice).

We are concerned about the violation, in that, your control of the Measuring

and Test Equipment (M&TE) program was not effective. Since at least 1992,

non-temperature compensated test gauges were used to calibrate safety-related

equipment.

This induced a common mode failure mechanism that contributed to

all three pressurizer pressure protection instrumentation channels being

inoperable. Although a reduction in safety margin resulted, the actual safety

consequences were low due to the fact that the reactor trip and safety

injection actuation, although delayed, would have occurred.

Additionally, we are concerned that the corrective action program failed to

fully evaluate and correct the problem when discrepancies were found and

documented in two Deviation Reports (DRs) and when the test gauge was found to

be defective. Consequently, the unit operated for approximately seven months

in violation of Te~hnical Specifications.

You are required to respond to this Notice and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence.

Your response may reference or

include previous docketed correspondence, if the correspondence adequately

addresses the required response. After reviewing your response to this

Notice, including your proposed corrective actions and the results of future

inspections, the NRC will determine whether further NRC enforcement action is

necessary to ensure compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice", a copy of

this letter and its enclosure will be placed in the NRC Public Document Room

(PDR).

To the extent possible, your response should not include any personal,

privacy, proprietary, or safeguards information so that it can be placed in

the PDR without redaction.

However, if you find it necessary to include such

information, you should clearly indicate the specific information that you

desire not to be placed in the PDR, and provide the legal basis to support

your request for withholding the information from the public.

The responses directed by this letter and the enclosed Notice are not subject

to the clearance procedures of the Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.
