REVIEW OF PROPOSED PLAN CHANGE REQUEST FOR EMERGENCY PLAN CHANGES FOR SURRY Gentlemen:
We have completed our review of your proposed Plan change which would eliminate the requirement for 30 and 90 minute response times in TABLE 5.1, "Minimum Staffing Requirement for Emergencies" and the deletion of TABLE 5.2, "Emergency and Recovery Corporate Response Required For Nuclear Station Emergencies" as currently written in your Surry Power Station Emergency Plan.
Our review concluded that the proposed Plan change would not be consistent with current guidance and criteria used to determine if a licensee's ability to augment onshift emergency response in a timely manner is acceptable.
Our review concluded that the proposed revision would decrease the effectiveness of the currently approved emergency plan.
The bases for our conclusion are contained in the enclosed Safety Evaluation Report.
Your proposed change request was communicated-to us in your letter dated February 18, 1994.
In that letter, you characterized the proposed change as a Cost Beneficial Licensing Action.
NRC Administrative Letter 95-02:
Cost Beneficial Licensing Actions, discusses the purpose and prerequisite for an item to be considered a Cost Beneficial Licensing Action.
For your convenience and future reference, a copy of NRC Administrative Letter 95-02 is also enclosed with this letter.
Please be reminded that 10 CFR 50.54(q) requires that proposed changes which decrease the effectiveness of your Emergency Plan may not be implemented without application to and approval by the Commission.
However, changes may be made without Commission approval if such changes do not decrease the effectiveness pf the Plan, and the Plan, as changed, continues to meet the standards of 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50.
If a change is made without approval, you should furnish copies in accordance with 10 CFR 50.54(q). Also, any changes to the Emergency Plan Implementing Procedures should be made in accordance with the requirements of Appendix E to 10 CFR Part 50.
