REVIEW OF REVISION 40 TO EMERGENCY PLAN FOR THE SURRY POWER STATION, DOCKET NOS. 50-280 AND 50-281 We have completed our review of Revision 40 to your Emergency Plan.

This review concluded that the changes in this revision did not decrease the effectiveness of the Plan, which continues to meet the planning standards of 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50.

During the course of the subject review, we noted that changes were made to Appendix 10.7 to address the NRC's previous determination of decreased Plan effectiveness, as communicated to you in our letter dated May 3, 1995.

These changes, together with the explanatory information provided in your letter of June 9, 1995 (Serial No.95-246), satisfactorily resolve that previous finding.

Please be reminded that 10 CFR 50.54(q) requires that proposed changes which decrease the effectiveness of your Emergency Plan may not be implemented without application to and approval by the Commission.

However, changes may be made without Commission approval if (1) such changes do not decrease the effectiveness of the Plan, and (2) the Plan, as changed, continues to meet the standards of 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50.

Copies of all Emergency Plan changes, whether made with or*

without prior approval, should be furnished to the Commission in accordance with 10 CFR 50.54(q).
