Dear Mr. Cline:
This letter officially informs you of the Federal-Emergency Management Agency's (FEMA) identification of a Deficiency that occurred during the Surry Power Station Radiological Emergency Preparedness (REP} exercise conducted on August 3, 1999.
This issue was *discussed during the post-exercise participants briefing on August 6, 1999.
The Deficiency is.being assessed against the James City County' Emergency Operations Center under Objective 3.
The Deficiency resulted because of the following:
At 1235, James City County EOC staff received and immediately began* to implement protective action recommendations (PARs) to evacuate Zones 18A, B, C, and D,* and 22A and B, and to shelter-in-place Zones 23 and 24. The governor confirmed the re*commendati.ons with a decisio,n, which was received by the county at 1306; the sirens were sounded by 1312. Implementation action*s taken by the county during the 31 minutes before the governor made a decision included two press releases containing protective actions. The first one (at 1241) adviied all residents to take shelter in those zones being sheltered {which were not specified in the press release), and the second (at 1244) was a precautionary sheltering advisory for livestock and poultry. In addition, three buses and a van were dispatched (simulated) by the Transit Administra~or to assist with evacuation of special populations.
The implementation activities are of concern because, if the governor had not concurred with the protective actions as recommended, or had changed the affected zones, the actions taken by the county before siren and E~S a~tivation might have confused the public, possibly causing panic. The EOC also did not act in concert with the other risk counties.
The County Plan 5tates ENCLOSURE
e that James City County press releases to local media representatives will be coordinated with the PIO at the State Joint Public Information Center (JPIC), which was not done in this case. Coordinating with JPIC would have alerted the county PIOs that they were acting in advance of the governor's decision (James City County RERP, p. 25).
Also, the Sample News Releases in the James City County Plan indicate that PARs are "orderedn by the governor (Appendix 2, ~ttaohment 8).

In accordance with 44 CFR 350.9(d) and FEMA-REP-14, we have thoroughly reviewed and discussed this issue with FEMA Headquarters, the U.S. Nuclear Regulatory Commission, and FEMA Region III's Regional Aseistance Committee members.
FEMA-REP-14, page C.16-1, defines a Deficiency as... "an observed or identified inadequacy of organ,izational performance in an exercise that could cause a finding that offsite emergency preparedness is not adequate to provide reasonable assurance that appropriate protective measures can be taken in the event of a radiological emergency to protect the health and safety of the public living in the vicinity of a nucl"ear power plant." Because of the potential impact of a Deficiency on the public health and safety, it should be corrected within 120 days after the exercise through appropriate remedial actions, including remedial exercises, drills, or other actions, including plan revisions.
Please coordinate ~ith this office the date and time of the pertinent remedial actions for James City County, Office of Emergency Services, within 10 days from the date of the letter.
