Dear Mr. Eisenhut:
By your letter of August 14, 1981, you stated that Virginia Electric and Power Company would have until 30 days after the Commission completed action on the industry petition to extend the June 30, 1982, deadline for environmental qualification in which to request a hearing regarding the Orders imposing EP requirements for the North Anna Power Station, Units 1 and 2, and the Surry Power Station, Units 1 and 2.
As you know, the Commission published its final rule on environmental qualification on January 21, 1983.
48 Fed. Reg. 2729 (1983).
That final rule becomes effective today, February 22, 1983, at which time Commission action on the industry petition has been completed.
Vepco is in the process of reviewing the new rule.
The Company has not yet determined whether it wishes to ask for a hearing, but it will make that determination within the 30-day period following February 22 (that is, by March 24, 1983) and advise you in writing by that date.
