SUMMARY

OF MAY 10, 2018, PUBLIC MEETING WITH NUCLEAR ENERGY INSTITUTE REGARDING APPENDIX XTO NEI 05-04, NEI 07-12, AND NEI 12-13, FINDING AND OBSERVATION CLOSURE PROCESS On May 10, 2018, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting 1 with staff from the Nuclear Energy Institute (NEI). The purpose of the meeting was to discuss the independent assessment finding and observation (F&O) closure process described in Appendix X to NEI 05-04, NEI 07-12, and NEI 12-13. Specifically, the meeting was to discuss a process for making observation reports publically available and to provide the NRC staff's feedback from previous observations of licensee implementation of the F&O closure process.

During the meeting, the NRC staff presented slides that provided feedback from NRC staff observations of licensees implementing the F&O closure process. 2 As detailed in the slides, the NRC observed that one licensee had peer review results based on a full scope peer review performed before NEI 00-02 and other supporting documents endorsed by RG 1.200 were issued. The NRC staff stated that the license amendment requests submitted using peer reviews performed prior to the NEI 00-02 guidance were resulting in increased review efforts and longer schedules. The NRC staff provided options to address this issue. The NEI representatives indicated that it may be a small population of licensees that have the issue and, therefore, it may not need a generic solution. The NEI staff indicated that they would determine how many licensees had peer reviews performed prior to NEI 00-02.

The NEI staff gave a presentation of their feedback on the NRC's observation of the closure process. 3 The presentation indicated that the industry was supportive of, and saw benefit to, continued NRC observation of the F&O closure process. Additionally, NEI indicated that there was a desire to allow licensees who hosted observations to have an opportunity to provide a fact check on the NRC observation report prior to publication. Broaddus there were several current programs for other NRC products that provided for factual verification by the subject of the product (e.g., plant-specific information used in an Information Notice) and that those processes could be applied to F&O closure observations. The NRC staff committed to evaluate the programs to find the most appropriate process to use to make F&O closure observations reports publically available.

No regulatory decisions were made and both the NRC and NEI staffs indicated that they would consider the items discussed in the meeting.

Following the discussion, an opportunity was afforded to any other participants who wished to ask questions or make comments. No questions or comments were received in the meeting.

Following the meeting, a voicemail was received from a member of the public who was in attendance, who indicated that they felt the process was not rigorous.
