Your reasons fo.r requesting the withholdi:ng of this information were that:

The SHOCK-2 and SHOCK-3 computer codes were developed at considerable expense to S&W and that if a competitor obtained the subject codes, it would i*mprove the competitive position in the area of pipe stress analysis.

Moreover, it i,s cu,stomary for S&W and its competitors to treat their computer p.rograms for pipe stress analysis as confidential.

Therefore, the subject computer codes are not available fF0m any public source.

Inf.orQ1atfon consisting of source.program listings of computer programs SHOCK 1-3, PSTRESS and NUPIPE-SW are al so not available in the public domai*n.

The compute.r programs for SHOCK 1-3 and PSTRESS are owned by S&W *. However, the NUPIPE program was obtained by S&W from the Nuclear Services Corporation under a leasing agreement.

S&W has since made certain improvements and added certain capabilities to NUPIPE, which are proprietary a;nd owned by S&W.

For this reason, you state that this r *ogram is sometimes referred to as NUPIPE-SW.

You further state that this information is not disclosed to the public because it*

involves a process which requires the performance of substantial amounts of numerical calculations or requires the investigation of several design alternatives which, if completed manually, would be prohibitively time consuming or impossible to complete.

However, when-accomplished by using a computer program, the process would be completed in reasonable time and at reasonable expense.

The information alsti consists of supporting data for the analysis, including test data, relative to a process (or component, str,ueture, method, etc.), the appreciation of which data secures a competive economic advantage, e.g., by optimization or improved marketability.

Over the years, this has included the development of heat transfer, nuclear analysis and transient analysis codes, incl,udin.g an experimental data base to support them.

The use of such a computer program not in the public do'main constitutes a competitive advantage fo.r S&W over other engineering and construction orga ni zat i o.ns.

  • criteria of 10 CFR 2.790 and have determined that the information described above sought to be withheld from public disclosure contains ;:,roprietary e-orrrnercial information.

We have also found at this time that the right of the pu:,lic to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of Stone and Webster.

Engineering Corporation and Nuclear Services Corporation's competitive positions. Accordingly, we have determined that the infoma:ion should be withheld from public disclosure.

We, therefore~ approve your request* for withholding pursuant to Section 2.790 of.10 CFR Part 2 and are withholding the docunents sub~itted by your applications dated March 22 ~nd April 6, 1979 from public inspection ~s proprietary. Withholding from public inspection shall rot affect the right, if any, of persons properly and directly concerned to inspect the doucments.

If the basis for withholding this information from publ i: inspection should change in the future such that the information co~ld then be made available for public i.nspection, you should pror.iptly notify the NRC.
