WESDYNE SECURITY COGNIZANCE AGREEMENT TERMINATION
Dear Ms. Jump:
In 2004, the U.S. Nuclear Regulatory Commission (NRC) determined it was in the best interest of the common defense and security of the United States to allow commercial reactor vendors access to classified information that would inform the safety of reactors being designed at the time. One of these vendors was Westinghouse. To accomplish this, in lieu of a facility clearance (FCL), the NRC entered into a Security Cognizance Agreement (SCA) with the U.S. Department of Energys (DOE) Chicago Operations Office stating that DOE would maintain security responsibility and oversight of NRC interests at WesDyne International, LLC (DOE Facility Code 8152). The agreement was finalized on November 24, 2004, by Mr. Thomas Gradle, Director, Office of Safeguards and Security, DOE Chicago Operations Office.
Presently, there is no identified need for Westinghouse personnel to access NRC-cognizant classified information and all NRC-issued personnel security clearances have been terminated.
Therefore, we see no need to maintain the existing SCA and are hereby terminating it. Should the NRC determine in the future that Westinghouse personnel once again needs access to NRC-cognizant classified information, Westinghouse can apply for an NRC FCL under Title 10 of the Code of Federal Regulations, Part 95.
