LETTER RELATED TO THE PUBLIC MEETING OF MARCH 28, 2018, REGARDING AVOIDING DELAYS IN ISSUANCE OF U.S. NUCLEAR REGULATORY COMMISSION COMBINED LICENSES
Dear Mr. Tschiltz:
The U.S. Nuclear Regulatory Commission (NRC) is providing this letter as a follow-up to the public meeting held on March 28, 2018, regarding the Nuclear Energy Institutes (NEI) proposals for avoiding delays in issuance of combined licenses (COL) when a COL applicant references a design certification with known errors. The meeting summary (Agencywide Documents Access and Management System Accession No. ML18092A066), dated April 24, 2018, noted that the NRC staff planned to internally convene decision makers in order to decide next steps, and develop a schedule for additional activities, if any.
Subsequent to the public meeting, the NRC staff and management discussed this issues history and the potential next steps. The meeting resulted in a decision to consider this issue in the planning for the Commission directed rulemaking related to Title10 Code of Federal Regulations Parts 50, Domestic Licensing of Production and Utilizations Facilities, and 52, Licenses, Certifications, and Approvals for Nuclear Power Plants licensing process alignment (SRM-SECY-15-002, Proposed Updates of Licensing Policies, Rules, and Guidance for Future New Reactor Applications, September 22, 2015, ADAMS Accession No. ML15266A023). This approach will allow this issue to be considered in the context of other changes that may be made to licensing processes under 10 CFR Part 50 and Part 52. In addition, rulemaking processes allow for Commission engagement and opportunities for public input and comment.
