OF MEETING WITH THE DEPARTMENT OF STATE AND DEPARTMENT OF ENERGY TO DISCUSS APPROPRIATE CONTROLS FOR RESTRICTED DATA OWNED BY THE GLOBAL LASER ENRICHMENT FACILITY AND ACCESS BY FOREIGN NATIONALS On April 23, 2018, representatives from the U.S. Nuclear Regulatory Commission (NRC) met with the U.S. Department of Energy and the U.S. Department of State to discuss appropriate access to U.S.-developed restricted data (RD). The NRC staff provided a slide presentation on observations from the staffs visit to the SILEX Systems Limited headquarters in Australia and the interactions with staff from the Australian Safeguards and Non-proliferation Office (i.e.,
Australian regulator), see the trip report (Agencywide Documents Access and Management System Accession Number ML18094A161).
The interagency working group discussed options for controlling access to RD. There was general agreement to put in place a written procedure to review requests from Global Laser Enrichment (GLE) for expanded access to RD on a case-by-case basis. Such a process could be documented in future revisions of the Administrative Security Arrangements (i.e.,
implementing procedures for the 123 Agreement on SILEX).
The parties also discussed the appropriate controls for transferring RD outside of the U.S. The NRC staff is developing a letter to GLE regarding access to RD. The interagency working group requested to review the letter once it is drafted.
