SUMMARY
OF MANAGEMENT ACTIONS suspensions based on presumptive positives:

o Appeals/Resolutions:
During the time period January 1, 1994 to June 30, 1994, five appeals were resolved.
One appeal resulted in reversal of original action.
Two fitness-for-duty appeals involved allegations that HHS laboratory results were incorrect.
One fitness-for-duty appeal resulted from a determination of "failure to co-operate" wherein the individual left site after notification of random testing.
One fitness-for-duty appeal involved a claim that prescription medication contributed to a positive alcohol test result.
One appeal resulted from access denial based on a psychological determination of lack of trustworthiness and reliability.
Trends:

Opiates:
No MRO positives since the Fitness For Duty rule went into effect.
o Fewer challenges to the accuracy and validity of HHS laboratory test results.
o Number of confirmed positives reduced by approximately 50% as compared to same time periods during previous years.

Recommendat~ons:
o Eliminate the second breath alcohol test when the first test -is negative.
After greater than 64,000 breath tests, equipment sensitivity of 100% has been demonstrated (second breath test has never been positive after the first breath test was negative).
Cost savings over months to years would be considerable.
o Continue to permit/encourage on-site pre-screening.
o consider moving toward 11 interchangeability" and mutual acceptance among regulated Fitness-for-Duty programs (NRC, DOT, RSPA).
comments:
PSE&G has enthusiastically adopted the 50% random testing rate reduction.
From a cost benefit standpoint, pre-access testing has proven to be most effective while the 100%
random testing rate has consistently provided "low yi~l~'
(below 1%) positives.
Based on the average number of active badges (3,899r, and testing at a rate of 1% per week, the number of random tests required during this six month period was 1,014.
