By letter dated August" 6", 1"993' Publid** ser~ice:;*Eiectr"lc' and Gas Company (PSE&G) *submitted to the :Nuclear Regulatory commission (NRC) the subject license change request (LCR) for an amendment to Appendix B (Environmental Protection Plan) of Facility Operating Licenses DPR-70 and DPR-75.

The submittal proposes to modify Section 4. 2.1, "Aquatic Monitoring", in Appendix B, pertaining tq monitoring requirements intended for the preservation of endangered species (sea turtles).

The changes include:

(1)

Increase of the monitoring frequency of the circulating water intake objects and species collection barriers, from bi-hourly to hourly if a lethal incidental take of an endangered or threatened species occurs between June 1 and September 30, 1993, that is directly attributable to the plant intake structure. Re-establishment of bi-hourly monitoring from October 1 through October 15; but

. if a lethal take occurs,. monitoring must again. be conduc.:tec1. hourly.

Notification and reporting to the NRC will continue in accordance with Section 4.1 of Appendix B.

The licensee's justification for this LCR is the need to incorporate in Appendix B the changes included in the May 14, 1993, Section 7 Consultation Biological Opinion, issued by National Marine Fisheries Service. The changes are administrative in nature and would in no way affect plant or equipment operation.

The New Jersey Department of Environmental Protection and Energy's (NJ DEP&E)

Bureau of Nuclear Engineering (BNE) staff reviewed the above amendment, in accordance with the requirements of 10 CFR 50.91(b), and has no comments.

In addition, the staff of NJ DEP&E's Division of Fish, Game and Wildlife reviewed the request and concurs with these changes so long as annual lethal and non-lethal impingements do not exceed the levels permitted by the National Marine Fisheries Service.
