The purpose of the public meeting was to respond to stakeholder comments from the December public meeting and to share some additional options for improving the method of calculating annual fees for fuel facilities.

BACKGROUND:

On December 13, 2017, a public meeting was conducted to discuss the method used to calculate annual fees for fuel facilities and solicit input on potential changes to the method. Participants were requested to submit comments by January 17, 2018. A meeting summary is available in the Agencywide Document Access and Management System (ADAMS) at Accession Number ML18004A135.

R. Johnson DISCUSSION:

The U.S. Nuclear Regulatory Commission (NRC) staff explained that the objectives included (1) reviewing the comments from the last meeting, (2) discussing NRC staff responses and some additional possible approaches, (3) obtaining stakeholder input, and (4) answering questions. No decision has been made to change the method used to calculate annual fees for fuel facilities. No changes to the method will be included in the final rule for Fiscal Year 2018 Fees. The NRC values the input of external stakeholders and wants to allow time for a meaningful exchange of ideas. The NRC staff will review external stakeholder input and incorporate stakeholder perspectives as appropriate.

After the opening remarks, two slide presentations were made concerning budget related topics. They included (1) a general overview of the budget process and (2) feedback on budget related topics raised in stakeholder comment letters. The documents are available in ADAMS at Accession Number ML18082A599. In the general overview, NRC staff explained the reconciliation of the Fuel Facilities Business Line Budget (in the Congressional Budget Justification) and the Fee Class Budget (used in the fee rule). Information on the Low-Level Waste Surcharge was presented also. The feedback presentation addressed a number of stakeholder comments including a request to provide a detailed breakdown of the fuel facilities budget. There was an extensive discussion of the budget related topics.

After a break, NRC staff presented information responding to stakeholder comments on the fee matrix used to calculate annual fees. Comments on the three possible approaches presented in the December meeting were discussed. Then, two additional approaches were introduced. The first new approach made changes suggested by stakeholders in the existing matrix. The impact of the changes on the annual fees was shown. The second new approach based the matrix on areas regulated by NRC instead of processes authorized by NRC. The impact of the new matrix on annual fees was shown. There was an extensive discussion of the possible approaches.

RESULTS:

The NRC staff requested that comments in connection with this public meeting be submitted by April 27, 2018. After evaluating the comments, the NRC staff intends to prepare any recommendations on this issue to be included in the Commission paper for the FY19 proposed fee rule. Several participants stated that they intended to provide additional comments.
