Dear Mr. Dougherty:

On April 20, 1993, members of our staff (John R. White, Chief, Reactor Projects Section 2A; Thomas P. Johnson, Senior Resident Inspector; and Stephen T. Barr, Resident Inspector) met with Mr. Steven Miltenberger and others of his staff to review the results of Public Service Electric and Gas Company's (PSE&G) special investigation of concerns brought to your attention by certain PSE&G employees relative to alleged misconduct of some Salem site managers.* We understand that you initiated the investigation on or about January 27, 1993, upon receipt of a letter from one of the involved individuals. We further understand that the individual indicated that he was subjected to intimidating treatment from certain Salem site managers as a result of his attempt to raise a safety concern, and may have been threatened with re-assignment.

Additionally, we understand that the individual considered such

  • treatment contrary to the requirements of 10 CFR 50. 7, "Employee protection." If any of our understandings are incorrect, please advise Mr. John White of our office within 10 days of the date of this letter.

Mr. Miltenberger informed us that your investigation determined, in part, that the behavior and performance of certain Salem site managers, relative to their treatment of the involved employees, was unprofessional and inappropriate.

He also stated that your investigation indicated that a confrontational and hostile environment existed between the involved Salem site managers and the involved employees' organization.

While the NRC is still reviewing this matter, we note that a hostile work environment could have a chilling effect on other licensee or contractor personnel, and deter individuals from identifying nuclear safety concerns to your organization or the NRC.. If such a hostile work environment exists it would violate the requirements of 10 CFR 50. 7 and would require immediate corrective action to resolve the sitilation. Consequently, we request that you provide this office, within 30 days of the date of this letter, a response which:

Describes the actions, taken or planned, to assure that the real or perceived

  • impact of this event on the involved employees, does not have a chilling effect in discouraging all licensee or contractor employees from raising safety concerns to Salem management or the NRC.
