RETRACTION OF DISCHARGE REPORT PUBLIC SERVICE ELECTRIC AND GAS COMPANY SALEM GENERATING STATION CASE NO. 92-11-18-0837-54 On November 18, 1992, PSE&G reported a discharge of battery acid from a ruptured battery to a stone surfaced at the Salem Generating Station.
Upon investigation, PSE&G has determined that this discharge was to an impermeable asphalt area as defined in NJAC 7:1E-1.6.
All acid was neutralized and cleaned up by the response personnel and the area restored to normal with no discharge into the waters or lands of the State in accordance with the requirements of the definition of "leak".
It is PSE&G's interpretation of the regulations that as this incident involved a leak onto a surfaced area and was cleaned up immediately as provided in NJAC 7:1E~l.6, it is exempt from this reporting requirement.
PSE&G believes and maintains that it acted in accordance with the intent of NJAC 7:1E-5.3 which requires all major facilities to notify NJDEPE of discharges of potentially haza~dous substances in any concentration.
