COMMENTS ON REVISED SECTION 7 CONSULTATION, BIOLOGICAL OPINION SALEM GENERATING STATION UNITS NOS. 1 AND 2 DOCKET NOS. 50-272 AND 50-311 HOPE CREEK GENERATING STATION DOCKET NOS. 50-354 Public Service Electric and Gas Company {PSE&G), has reviewed the revised Section 7 Consultation, Biological Opinion, prepared by National Marine Fisheries Service (NMFS) and issued to PSE&G by the NRC on August 25, 1992.

PSE&G submits the following comments within 90 days, as requested.

0 240038 The Section 7 Consultation transmittal letter from W. W.

Fox, Jr. (NMFS) to S. A. Varga, (NRC), dated August 4, 1992, allows 2 green and 1 Kemp's ridley mortality.

The Incidental Take Statement within the Section 7 Consultation itself, however, allows a take limit of 5 Kemp's ridley and 5 green turtles with up to two mortalities.

PSE&G considers the Incidental Take Statement to have precedence over the transmittal letter.

PSE&G interprets the number of endangered mortalities in the Incidental Take Statement to be 2 green and 2 Kemp's ridley and requests concurrence from the NRC on this interpretation.

PSE&G's understanding of this revised Section 7 is that it relieves Hope Creek Generating Station of the requirements involved with monitoring for sea turtles outlined in section 4.2.1 of Appendix B to the Environmental Protection Plan (EPP).

PSE&G intends to revise section 4.2.1 of the EPP, with concurrence from NRC, and remove those portions that require monitoring actions for sea turtles.

In Table 3, "Lepidochelys kempi Incidental Captures", of the Biological Opinion section, PSE&G believes the first entry, August 11, 1980, is in error.

PSE&G requests that this record of ~ kempi be removed from the NMFS data base.

Our records of August 11 only show the supposed green turtle caught by trawl and listed as such in Table 1.
