RETRACTION OF DISCHARGE REPORT PUBLIC SERVICE ELECTRIC AND GAS COMPANY SALEM GENERATING STATION CASE NO. 92-05-09-1118-09 On May 9, 1992, PSE&G reported a discharge of approximately one (1) gallon of diesel fuel to a stone surfaced area in the laydown area southwest of the Unit 1 containment. The discharge was assigned Case No. 92-05-09-1118-09 by Operator 18.

Upon investigation of the discharge and review of applicable regulations, PSE&G has determined that this discharge was to an impermeable surface as defined in NJAC 7:1E-1.6. All oil was cleaned up immediately and removed prior to any escape into the waters or lands of the State in accordance with the requirements of the definition of "leak". It is PSE&G's interpretation of the regulations that as this incident involved a leak onto a surfaced area and was ci'eaned up immediately as provided in NJAC 7:1E-1.6, it is exempt from this reporting requirement.

PSE&G believes and maintains that it acted in accordance with the intent of NJAC 7:1E-5.3 which requires all major facilities to notify NJDEPE of discharges of potentially hazardous substances in any concentration.
