..*.f Pubiic Service Electric and Gas Company P.O. Box 236 Hancocks Bridge, New Jersey 080~8 Nuclear Department CERTIFIED MAIL RETURN RECEIPT REQUESTED ARTICLE NUMBER: P 063 762 084 MAY 2 7 1992 NLR-E92150 NJ Department of Environmental Protection and Energy Bureau of Communications and Support Services 401 East State Street CN 028 Trenton, NJ 08625-0028

Dear Sirs:

RETRACTION OF DISCHARGE REPORT PUBLIC SERVICE ELECTRIC AND GAS COMPANY SALEM GENERATING STATION CASE NO. 92~05-11-0812-39 On May 11, 1992, PSE&G reported a discharge of approximately one half (~) gallon of diesel fuel and one half (~) gallon of lubricating oil to a stone surfaced area in the laydown area southwest of the Unit 1 containment. The discharge was assigned Case No. 92-05-11-0812-39 by Operator 18.

Upon investigation of the discharge and review of applicable regulations, PSE&G has determined that this discharge was to an impermeable surface as defined in NJAC 7:1E-1.6. All oil was cleaned up immediately and removed prior to any escape into the waters or lands of the State in accordance with the requirements of the definition of "leak". It is PSE&G's interpretation of the regulations that as this incident involved a leak onto a surfaced area and was cleaned up immediately as provided in NJAC 7:1E-1.6, it is exempt from this reporting requirement.

PSE&G believes and maintains that it acted in accordance with the intent of NJAC 7:1E-5.3 which requires all major facilities to notify NJDEPE of discharges of potentially hazardous substances in any concentration.

Should you have any questions on this issue, please feel free to contact Pat McCabe of my staff at (609) 339-1245.

Sincerely,

~.,,r~ /

The Energy People F. X. Thomson, 4r.
