During an inspection at the Saint Raymond Corporation paper mill located in Pejepscot, Maine on October 12, 1989, we learned that the Saint Raymond Corporation is no longer solvent and the mill has been foreclosed upon by the Swiss Bank Corporation.
The inspector also learned that one Kay Ray nuclear gauge containing 10 millicuries of cesium-137, three Measurex krypton-85 beta gauges, and a radium source remain in the facility.' Neither the Saint Raymond Corporation nor the Swiss Bank Corporation are licensed to possess the cesium-137 source; the krypton-85 sources may be possessed under the general license authorization in 10 CFR 31.5, (enclosed) and the radium source is regulated by the State of Maine.
Title 10 of the Code of Federal Regulations, Section 30.3 requires that no person possess or use byproduct material except as authorized by a specific or general license issued pursuant to Title 10.
Therefore, possession of the cesium-137 source by your company without a valid NRC license is contrary to NRC regulations.
Based on a telephone discussion between you and Mr. John Miller of this office on October 17, 1989, we understand the following:
l.a. You will immediately submit an application to the NRC for a license for Swiss Bank Corporation, authorizing the possession and storage of the Kay Ray nuclear gauge containing the 10 millicurie cesium-137 soufce; of
- b. You will within 15 days divest yourself of the gauge containing the cesium-137 source by returning the Kay Ray gauge to the manufacturer or another licensee authorized to possess the devices.
If you elect to return the gauge, you will inform the NRC, prior to movement of the gauge, of the procedures that will be used to handle the gauge and the licensee who will perforfil the return.

In addition, prior to releasing the Pejepscot paper mill to a prospective buyer, you will ensure the new owner has a valid NRC license authorizing the possession of the gauge, if the gauge remains at the mill.

You will maintain the gauge with the shutter in the closed position and maintain the sealed source in a secure fashion such that unauthorized use or removal is prevented.

Issuance of this Confirmatory Action Letter does not preclude the issuance of an Order formalizing the above commitments or other enforcement action relative to licensed activity.
