NOTIFICATION REGARDING EMPLOYEES' POTENTIAL SAFETY ISSUES SALEM AND HOPE CREEK GENERATING STATIONS DOCKET NOS. 50-272, 50-311, 50-354 This will respond to your April 27, 1989 letter reemphasizing to licensees their responsibilities to assure that they, and their contractors and subcontractors, permit their employees to contact, without restrictions, the NRC with concerns about potential safety issues.

Public Service Electric and Gas Company (PSE&G) modified its contracts in July 1988 to include specific language referencing Section 210 and 10 CFR 50.7 and issued letters to all contractors on site reemphasizing employee protection requirements in an effort to better monitor and control contractor performance.

Copies of the contract language and letter are enclosed.

As a result of the foregoing actions and our review of cases known to have been brought before the Department of Labor, the Company is unaware of any instance where clauses have been included in settlement agreements restricting the ability of employees to provide information about potential safety issues to the NRC. All present contractors at the site have been requested to confirm the absence of any restrictive clauses in settlement agreements and if any are identified to promptly notify the employee that the restriction should be disregarded, that he or she may freely go to the NRC without fear of any retribution, and that such restriction will not be enforced. To date, no contractor has identified any such restrictive clause.
