Dear Mr. Kammerer:

I would be interested in learning the answers to several questions which have arisen has a result of the enclosed correspondence.

Does the Nuclear Regulatory Commission have any record of corres=

pondence from the Fort Pierce Utilities Authority regarding the license application of the St. Lucie II (Hutchinson Island) project?

Did the Nuclear Regulatory Commission notify the Fort Pierce Utilities Authority of the possibility it might participate in this project if it expressed such an interest? Is there any. statutory requirement that a certain per-centage of the "pie" be offered to adjoining smaller systems?

And, finally, does the Fort Pierce Utilities Authority have any legal recourse at this time if it wasn't properly notified of the possibility it might participate in this project?

Xour cooperation in helping me determine the answers to these questions would be appreciated.

With best wishes and warm personal regards, I remain LAB:jaw Enclosures L. A. "Skip 'afalis Member of Congress Pcc'd Oit. Oli.

Ãe believe that we must be consistent in following the policy with respect to the St. Lucie plant.

Xf we were to expand our offer of j>articipation at this time it would be difficult, and unfa ir, to offer participate on to some systems but not to others.

And a general offer at this late date would introduce subsLantial uncertainties into our own system planning.
