REQUEST FOR EXEMPTION

.ANNUAL EMERGENCY PREPAREDNESS EXERCISE NO. l AND 2 UNITS SALEM NUCLEAR GENERATING STATION DOCKET NOS. 50-272 AND 50-311 10 CFR S0.54(q) requires a licensee authorized to operate a nuclear power reactor to follow and maintain in effect emergency plans which meet the standards of 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part SO.

Sec-tion IV.F.l of Appendix E requires each licensee to conduct a full-scale emergency preparedness exercise annually, un-less the State and local g_overnments in the plume exposure pathway emergency planning zone have participated in a full-scale exercise during the annual period (such participation could be in conjunction with.another power plant).

The last full-scale emergency exercise at Salem was conducted on April 9, 1981.

The exercise for the current

  • year had been scheduled for May 19, 1982.

As a result of a labor strike against PSE&G by the International Brotherhood of Electrical Workers, which commenced on May 1, 1982, upon contract expiration, PSE&G, NRC-IE R_e_gion I,* FEMA -

Regions II and III, and the State of New Jersey and* Delaware agreed to postpone the exercise until September 29, 1982.

The State of New Jersey has indicated a preference for an exercise date for Salem in September 1982 since they have already participated in a satisfactory. full-scale emergency preparedness exercise for the Oyster Creek nuclear facility earlier this year.

Accordingly, PSE&G hereby requests that an exemption from the schedule requirements of Section LV.F.l*of Appendix E to 10 CFR Part 50 be granted to allow the* next full-scale

. 7 /9/82 Nuclear Reactor Regulation emergency preparedness exercise to be conducted on or about September 29, 1982. It is also requested that the anniver-sary date for performance of future full-scale exercises be similarly changed.

A full-scale *practice* exercise was conducted on April 14, 1982, which included activation of PSE&G's Emergency Re_;

sponse Facilities, New Jersey and Delaware Emergency Cen-ters, and field operations.

This exercise was conducted in preparation for the formal exercise that had been scheduled for May 19, 1982.

The *practice" exercise was determined to be satisfactory and all deficiencies noted have been appro~

priately addressed.

Based on the above, we submit that granting the requested exemption will have no adverse effect on the state of emergency preparedness at Salem.

Dear Mr. Linden:

Your letter of July 9, 1982, requested an exemption from the requirement of 10 CFR 50, Appendix E, Section IV.F.l, to conduct an annual emergency pre-paredness exercise.

The last emergency exercise at Salem was conducted on April 9, 1981.

We understand that you were unable to meet the annual exer-cise requirement because of a labor strike against PSE&G at the time of the planned exercise, and that the next exercise has been scheduled for September*

1982 to allow for the full-scale participation of the State of New Jersey.

Based on the fact that you conducted a practice exercise on April 14, 1982, which included activation of onsite and offsite emergency response centers, and our belief that the most effectiv~ and beneficial annual exercises are those involving the full-scale participation of State and local government organizations, we find that the delay in performing your annual emergency preparedness exercise will not adversely affect the overall state of emer-gency preparedness at Salem.

The staff therefore concludes that an exemp-tion in accordance with.10 CFR 50.12 is authorized by law, will not endanger life or property or the common defense and security and is otherwise in the public interest, and approves your request for an exemption to the annual exercise requirement of 10 CFR 50, Appendix E, Section IV.F.l.

We request that you meet with representatives of our Region I office and also with the Federal Emergency Management Agency to develop an anniversary date for future exercises which takes into consideration the requirements of other nuclear power facilities in the region.
