preserve status quo of the*_ reracking {which we understand is about J8% complete) *
- We* informed the ASLAB that th~* Applicant (Public Se~vice
- Electric &*Gas) *was **in tli.e _process of *reracking.the Salem_*#l
- spent-. fuel pool.
- Chairman Christine Kohl denied our oral motion and.re'commended
- .that we put. in writing* our request,to en"joiri the applicant.

The Applicant *ha:s proceede.d with arrogant confidence *from the*
beginning; i.e.; -ordering the racks either before the.applica- -
tion was filed or at.least during the proceedings.*. The Applicant cont.inues as if to be above the *law.

extremely difficult to.understand how the applicant.can rerack whil~ a:ri appeal is pending resolution..
. It was our understanding~ that an initial decision directing an amendment to"an operating license would become ef'.feci;;ive unless a party had shown* good. cause,. subject to review by* the_ Commis'sion.

We have not seen-any writtenpermission allowing the Applicant to
. 'rerack; therefore,(we motion for an injunction to preserve. status quo and *suggest immediate* disciplinary penal ties be' invoked.
