  • Chairman Christine Kohl denied our oral motion and.re'commended

The Applicant *ha:s proceede.d with arrogant confidence *from the*

beginning; i.e.; -ordering the racks either before the.applica- -

tion was filed or at.least during the proceedings.*. The Applicant cont.inues as if to be above the *law.

extremely difficult to.understand how the applicant.can rerack whil~ a:ri appeal is pending resolution..

. It was our understanding~ that an initial decision directing an amendment to"an operating license would become ef'.feci;;ive unless a party had shown* good. cause,. subject to review by* the_ Commis'sion.
