Dear Mr. Minch:
M.l\\Y 2 1980 In your letter of May 1, 1980 the Maryland Public Service Commission requested the Nuclear Regulatory Commission to make available Mr. l~illiam T. Russell, Chief, Technical Support Branch, Office of Nuclear Reactor Regulation as a witness for the staff of the Maryland Public Service Commission to :testify regarding the performance of the Salem Nuclear Plant. and the Delmarva Power & Light Company. The hearing vJ~s to commence at 10:00 a~m. on May 6, 1.930. Due to the short notice provided and conflicts with Mr. Russell's work schedule he is unable to appear at the scheduled time. The Delmarva Po\\!Jer & Light Company is not licensed to operate any facility.:. regul ate-d by the Nuclear Regulatory Commission. NRC witnesses are thereforre*, '. unable to testify regarding the performance of Delmarva Power & Light. .!. "~ ::. \\, \\ Public Service Electric and Gas Company is licensed by the NRC to operate the-;\\\\ Salem Unit l nuclear power plant. Mr. Russell is able to provide testimony* \\' on technical issues concerning the seismic design of safety related piping '. \\' systems and supports \\'Illich significantly extended the J\\pril 1979 l"efueling at Salem Unit 1. Plant start-up from that refueling outage was delayed until**. December of 1979. The NRC actions taken and requirements imposed upon Salem Unit 1 between April 1979 and December 1979 involved the Offices of Nuclear Reacto~ Regulation and Inspection and Enforcement. Ih addition to Mr. Russell, the NRC 1 s Resident Inspector at Salem Unit l could be made available to provide testimony concern-ing the April 1979 extended refueling outage. The NRG ~*Jitnessess; however, would be unable to comment on issues related to utility management efficiency with respect to the length of the refueling shutdovm. They could comment on* the safety qua 1 i ty of the end product of the ut i 1 ity' s effort. This is due to the nature of the NRC's health and safety reviev1s and the fact that the plant was in a safe condition as long as it remained shutdown.* With respect 11::! Minch 2 - MAY 2 1980 It wo~ld be necessary'to delay the hearing for at least 60 days to allow coordination between NRG witnessess, NRC counsel and Maryland P,ublic Service Commission Staff Counsel to prepare. prefiled testimony or to arrange for* a deposition of NRC witnes*ses and to allow time for all parties to your.pro-ceeding to review the NRC witness* prefiled testimony or their deposition. It is estimated that three professional man.:.weeks of engineering effort, would be required to prepare'.the prefiled testimony and three or four man-days to prepare for and be deposed.* These estimates are based upon Mr. Russell.' s experience in a similar proceeding before the Maine Public Utility Commission* regarding'the seismic design of safety related piping systems and supports at the Maine Yankee *nuclear power piant. Considering efficient use of NRC manpowe.r and that depositions are used in similar proceedings* (Maine Yankee and Beaver Valley), NRC would recommend *the use of a deposition in lieu of prefiled testin:iony. Discussion between Mr. Russell and Mr. Decker, Staff Counsel for the Maryland ,Public Service Commission revealed that the request for Mr. Russell's testimony originated with Mr. Alexander of the Office of People's Counsel of Maryland, who represents the rate. payers in this proceeding. Mr. Decker* was unaware of what issues were to 'be addressed by NRC vlitnesses. ) .For reasons discussed above and Mr. Russell's-s.chedule conflict on May 6,. the. NRG.is unable to provide a witness on the schedule re<:tuested. In the event that the hearing is delayed and the issues to which NRG witnesses are expected to testify are better defined, the NRC would* be able to accommodate your request.
