By petitions dated October 18, 1979, Mr. and Mrs. Alfred Coleman

requested the Nuclear Regulatory Corranission to issue a show cause order.
to Public Service Electric and Gas Company, et.!!..* to suspend or revoke the operating license for Salem Unit 1, the construction pennits of Salem Unit 2 and Hope Creek Units l and 2, and stay issuance of the operating license for Salem Unit 2 because of alleged viol~tions of the Endangered Species Act of 1973. *The Colemans 1 petitions have been treated as requests for action under 10 CFR 2~206 of the Commission's regulations..
Noti<:e of receipt of the petitions was published in the Federal Register, 44 FR 67253 (November 23, 1979).
The NRC staff has prepared a biological assessment of the shortnos.e sturgeon in the Delaware River and has conducted formal consultation with the National Marine Fisheries Service. Based on the. conclusions set forth in the Staff's biological assessment and the results of the consultation with the NationalMarine Fisheries Servi"ce, I have determined that the operation of Salem Units 1 *and 2 and the construction_ and future operation of Hope Creek Units 1 and 2 is not likely to jeopardize-the continued exiStence of Adpenser.Q_revirostrum Lesueur, the shortnose sturgeon, a federally.recognized endangered species.
