DIRECTOR'S DECISION UNDER 10.CFR 2.206

  • DD-80-4 Docket No. 50-272 By petition dated October 18, 1979, Mr. and Mrs. Alfred Coleman requested the Nuclear Regulatory Corrmission to issue a show cause order to Public Service Electric and Gas Company to suspend or revoke the operating license for Salem Unit l because of alleged violations of the Endangered Species Act of 1973. The Colemans' petition has been treated as a req~est for action under 10 CFR 2.206 of the Commission's regulations. Notice of receipt of the petition was published in the Federal Register, 44 FR 67253 (November 23, 1979}.

After consideration of the information submitted in the Colemans' request and consultation with the National Marine Fisheries Service, I have determined that the continued operation of Salem Unit l will not result in any violations of the Endangered Species Act. Consequently, this request to suspend or revoke the license is denied.

A copy of this decision will be placed in the Commission's Public Document Room at 1717 H Street, N. W., Washington, D. C. 20555 ~nd at the local public document room for the Salem Nuclear Generating Station, *.Unit 1, located at Salem Free Public Library, 112 West Broadway, Salem, New Jersey 08079.
