STATUS OF RECOMMENDATIONS: AUDIT OF NRCS REGULATORY ANALYSIS PROCESS (OIG-15-A-15)
REFERENCE:
DIRECTOR, OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS, MEMORANDUM DATED FEBRUARY 21, 2018 Attached is the Office of the Inspector Generals (OIG) analysis and status of recommendations as discussed in the agencys response dated February 21, 2018.
Based on this response recommendation 3 remains in resolved status.
Recommendations 1, 2 and 4 were closed previously. Please provide an updated status of the resolved recommendation by May 15, 2018.
OIG issued this report in final on June 24, 2015, and by memorandum dated July 23, 2015, the agency acknowledged agreement with OIG on this recommendation.
Office of Management and Budget Circular No. A-123 (M-16-17), Section C, dated July 15, 2016, states Management has a responsibility to complete action, in a timely manner, on audit recommendations on which agreement with the OIG has been reached. Audit recommendation number 3 has been in resolved status for more than 21/2 years.

Audit Report AUDIT OF NRCS REGULATORY ANALYSIS PROCESS OIG-15-A-15 Status of Recommendations Recommendation 3: Update and implement the cost benefit guidance documents as planned in SECY-14-0002. Incorporate this guidance into office procedures by reference.
Agency Response Dated February 21, 2018: On April 17, 2017, the staff published in the Federal Register (82 FR 18163) a request for public comment on the draft NUREG/BR-0058, Revision 5, Regulatory Analysis Guidelines of the U.S. Nuclear Regulatory Commission.
The 60-day public comment period closed on June 16, 2017.
The staff considered and addressed, as appropriate, the comments submitted on the draft NUREG. The final NUREG is currently in publication review with an expected delivery to the Commission with a notation vote paper by April 2018. The staff updated interim Revision 2 of NMSS Policy and Procedure 6-10, NMSS Procedures for Preparation and Review of Rulemaking Packages, to reference the draft Revision 5 of NUREG/BR-0058 that was released in April 2017. Following Commission review and approval, the staff will revise its procedures to reference the final NUREG.

October 2017 (completed - updated NMSS Policy and Procedure 6-10)
April 2018 (target - issue notation vote paper with Revision 5 to NUREG/BR-0058)
OIG Analysis: The proposed corrective action addresses the intent of OIGs recommendation. This recommendation will be closed when OIG receives and reviews the updated cost benefit guidance documents, with evidence that the guidance documents are implemented and incorporated into office procedures by reference.
Status: Resolved.
