NRC PALISADES SECURITY INSPECTION REPORT 50-255/99002(DRS) AND

NOTICE OF VIOLATION

Dear Mr. Palmisano:

This refers to the security inspection conducted on January 19-22, 1999, at the Palisades

Nuclear Power Plant. The purpose of the inspection was to determine whether activities

authorized by the license were conducted safely and in accordance with NRC security related

requirements.

Your security program was effective in providing a level of protection that ensured public health

and safety. We noted that security equipment and facilities were effectively maintained and that

out-of-service equipment was reduced and that re-work activities were prevented. The

performance of equipment effectively assisted the security staff to protect the plant. We did note

some errors or weakness in security staff decision making and oversight that challenged the

effectiveness of your program unnecessarily. Your staff responded to those challenges

effectively by addressing or correcting the findings.

Based on the results of this inspection, the NRC has determined that one violation of NRC

requirements occurred. The violation was identified by the NRC. The violation is cited in the

enclosed Notice of Violation (Notice) and the circumstances surrounding it is described in detail

in the subject inspection report. The violation involved a failure to mark two security procedures

that contained protected information (Safeguards Information) and to properly store some copies

of one of those procedures. This violation is of concern because security managers had

previously reviewed both documents and had mistakenly determined that neither contained

information that had to be protected. The violation was corrected in a prompt and effective

manner.

The NRC has concluded that information regarding the reasons for the violation and the

corrective actions taken are adequately addressed on the docket in this Inspection Report

(50-255/99002). Therefore, you are not required to respond to this letter unless the description

choose to provide additional information, you should follow the instruction specified in the

Inspection activities also identified that licensee security managers are taking action to evaluate

the performance and safety impact of armed security response personnel while those individuals

are conducting assigned non-security fire brigade duties. Future inspections will review licensee

actions.

  • according to Part 73, Title 10, Code of Federal Regulations, Section 73.21. This information

must be handled and protected in.accordance with the provisions of 10 CFR 73.71.
