Current NRC Staff Views on Applying the 1987 Policy Statement on Deferre....pdf As you all know, several holders of Combined Licenses (COLs) issued under 10 CFR Part 52, have notified us of their intent to terminate a COL. Absent specific guidance, they have chosen several different approaches in their termination requests. Without prejudice to any of the existing submittals, this variation demonstrated the opportunity for improved clarity that would come from a staff position on the applicability of the existing Policy Statement on Deferred Plants to the holders of COLs.
The attached document represents the current NRC staff view, coordinated with the appropriate Offices, on how COL holders might apply the Policy Statement on Deferred Plants, should they choose to do so. Please use this guidance in your interactions with COL holders who are interested in this topic.
Consistent with the principles of openness and clarity, I plan on making this email and the attached document publically available in ADAMS. Your staffs can utilize the ADAMS ML number to reference or provide this document to external stakeholders while I evaluate the efficacy of additional external communications on this matter.
