consumers Power POWERINli MICHlliAN'S PROliRESS Palisades Nuclear Plant: 27780 Blue Star Memorial Highway, Covert, Ml 49043 October 9, 1995 US Nuclear Regulatory Commission Document Control Desk Washington, DC 20555 DOCKET 50-255 - LICENSE DPR PALISADES PLANT WITHDRAWAL OF REQUEST FOR LICENSE AMENDMENT FOR MHA ANALYSIS We are committed by the Palisades FSAR to Standard Review Plan Section 15.6.5 which requires that all potential leakage paths be considered when calculating control room and off-site doses.
In a letter dated June 14, 1991, Consumers Power Company (CPCo) identified that our analysis of the Maximum Hypothetical Accident (MHA) dose consequences had not considered all potential sources of leakage of radioactive primary coolant system water to the environment.
- Thus, the existence of an additional leakage path, combined with our inability to quantify the leakage through the path, led to our determination that an Unreviewed Safety Question (USQ) existed as the control room habitability and off-site doses could not be definitively calculated.
In accordance with 10 CFR 50.59, our June 14, 1991 letter requested that the Palisades Operating License be amended by granting an exemption from the FSAR requirement to perform the MHA analysis in accordance with the Standard Review Plan. Justification for Continued Operation (JCO) of the plant until the issue could be resolved was provided in letters to the NRC dated June 14, 1991, and January 10, 1992, and supplemented by letters dated April 21, 1992 and July 28, 1992.
The NRC's January 9, 1995, letter approved the JCO based on its enclosed safety evaluation "Safety Evaluation By The Office Of Nuclear Reactor Regulation Related To The Justification For Continued Operation Regarding The Potential For A Previously Unaccounted For Radioactive Release In The Maximum Hypothetical Accident Analysis".. The safety evaluation concluded that the JCO provided an acceptable basis for continued operation of the Palisades Plant until the end of January 1996, which is the date before which CPCo committed to submit a revised MHA analysis which complied with the Standard Review Plan.

Based on the NRC's January 9, 1995, Safety Evaluation Report approving interim plant operation and our commitment to complete an MHA analysis which complies with the Standard Review Plan by January 1996, we are now able to consider all potential sources of leakage of radioactive primary coolant to the environment and a license amendment is no longer needed.
The revised MHA analysis and resulting off-site and control room dose calculations will show compliance with plant licensing bases.
Therefore, this letter hereby withdraws our request of June 14, 1991, as revised on January 10, 1992, for the NRC to grant an exemption from the FSAR requirement to perform an MHA analysis in accordance with the Standard Review Pl an.
