Dear Chairman Small:

Thank you for your decision to participate in the U.S. Nuclear Regulatory Commission (NRC)

Advance Notification program for Native American Tribes, as stated in your January 31, 2018, letter. The letter can be found in the NRCs Agenywide Documents Access and Management System using Accession No. ML18060A389.

The Advance Notification to Native American Tribes of Transportation of Certain Types of Nuclear Waste (Advance Notification Rule) published on June 11, 2012 (77 FR 34194),

amended NRC regulations in Title 10 of the Code of Federal Regulations (10 CFR) Parts 71 and 73 to require licensees to provide participating Federally recognized Tribes advance notification of commercial irradiated reactor fuel shipments and nuclear waste shipments meeting the criteria of 10 CFR §71.97(b) which may be transported within or across Tribal reservations.

One of the requirements to receive advance notifications is to have Tribal designees complete Safeguards Information (SGI) training.

The NRC acknowledges the two designees that you identified below as having completed the required SGI training and are able to receive advance notifications of irradiated reactor fuel and nuclear waste shipments that are transported by NRC or Agreement State licensees under the requirements in 10 CFR Parts 71 and 73.

Finally, your designees will be contacted by NRC on an annual basis to confirm their contact information and status as the advance notification transportation designee for the Shoshone-Bannock Tribes.
