Rogers Plant Safety and Licensing Director DOCKET 50-255 - LICENSE DPR PALISADES PLANT - ADDITIONAL INFORMATION CONCERNING RENEWAL OF THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT The Palisades Environmental Protection Plan, Section 3.2, requires that the licensee provide the NRC with a copy of the application for renewal of the NPDES permit at the same time the application is submitted to the permitting agency.

In a letter, dated April 13, 1994, a copy of the application for renewal of the Palisades NPDES permit was transmitted to the NRC.

Because of new requirements concerning permitting of storm water outfalls, we have submitted the attached "Notice of Intent" application for coverage under the "State of Michigan Storm Water General Use Permit," to the State of Michigan.

The attached copy of the "Notice of Intent" application is being submitted to the NRC as additional information related to the April 13, 1994 submittal of our NPDES permit renewal application.

PALISADES PLANT - MICHIGAN'S STORM WATER GENERAL PERMIT NOTICE OF INTENT (NOi)

Dear Ms Harry:

In response to your letter of July 22, 1994, a Notice of Intent (NOi) application form for coverage under Michigan's Storm Water General Permit has beeri completed for the Company's Palisades Plant and is attached. Please coordinate/copy appropriate MDNR NPDES Permitting Staff both in Lansing and in the Plainwell District Office upon issuance of the Certificate of Coverage. NPDES Permit No. :MI 0001457 covering Palisades Plant operations is in the process of being renewed. The Plant's NPDES permit was public-noticed during the month of June and is now pending final issuance by Lansing permitting staff.

New Facilities: Facilities commencing industrial activity on or after the effective date of this general permit shall develop a Storm Water Pollution Prevention Plan prior to the submittal of this NOi. The plan shall be retained on site, but certification that the plan has been developed shall be submitted along with this NOi.

Upon commencement of industrial activity, the permittee shall certify, in writing to the District Supervisor of the Surface Water Quality Division, that the facility is in compliance with the terms of the pollution prevention plan and the ter.ms of the general permit.

NOTICE OF INTENT for coverage under National Pollutant Discharge Elimination System (NPDES)

GENERAL PERMIT Storm Water Discharges Associated with Industrial Activity By Authority of Act 245, P.A. 1929 as amended Submission of this Notice of Intent (NOi) constitutes notice that the party identified in Section I.A. of this form requests authorization to discharge under NP:JES General Permit No. MIROOOOOO issued for storm water discharges associated with industrial activity in Michigan. The Michigan Department of Natural Resources may deny coverage under this general permit and require subminal of USEPA application forms 1 and 2F for an inaividual permit or an application to be covered under an alternative general permit. Becoming a perminee obligates a discharger to comply with the terms and conditions of the general permit. Failure to comply with these provisions may result in fines of up to $25,000 per day and the possibility of imprisonment, in accordance with Act 245.
