SUBJECT:

SERVICE WATER SYSTEM OPERATIONAL PERFORMANCE INSPECTION

(50-255/94002(DRS))

This refers to the service water system operational performance inspection

(SWSOPI) conducted by Mrs. Sonia D. Burgess and others of this office on

January 10 through February 11, 1994.

The inspection included a review of

authorized activities at your Palisades Nuclear Generating Facility.: At the.

conclusion of the* inspection, the findings were discussed on February 11, 1994

with Mr. David Joos and members.of your staff, identified in the enclosed

report.

The enclosed copy of our inspection report identifies areas examined during

the inspection.

The team assessed the service water system's (SWS)

operational performance.

In particular,. the team reviewed in detail, the

SWS's design, maintenance~ operatiori, surveillance and testing.

The team also

assessed the planned or completed actions for Palisades in response to Generic

Letter (GL) 89-13, Service Water System Problems Affecting* Safety Related

Equipment," issued on July 18, 1989.

Based ori the results of this inspection, one apparent violation was identified

and is being considered for escalated enforcement action in accordance with

the "General Statement of Policy and Procedure for NRC Enforcement Actions"

(Enforcement Policy), 10 CFR Part 2, Appendix C.

Accordingly, no Notice of

Violation is presently being issued for these inspection findings.

In

  • addition, please be advised that the number and characterization of apparent *

violations described in the enclosed inspectjon report may change as a result

of furthet NRC review.

The apparent violation involved five examples where

inadequate or no corrective actions-were taken to previously identified

concerns.

One significant example identified a single failure vulnerability

that could lead to the loss of aJl engineered safeguards system pum~s. The

significance and number of design issues identified during this inspection led

the team to conclude that the system design was not clearly understood and no.

clear understanding existed between system and design engineering as to which

was responsible for system design.

An enforcement conference to discuss this apparent violation has been

scheduled for March 11, 1994, in the Region III office in Lisle, Illinois.

The purposes of this cohference are to discuss the apparent violation, their

cause(s), and safety significance; to provide you the opportunity to point out

any errors in our inspection report; and to provide an opportunity for you to

present your proposed corrective actions.

In addition, this. is an opportunity

for you to provide any information concerning your perspective on 1) the

severity of the issue, 2) the factors that the NRC consider~ when it

.

determines the amount of a civil penalty that may be assessed in accordance

with Section VI.B.2 of the Enforcement Policy, and 3) the possible basis for

exercising discretion in accordance with Section. VII of the Enforcement

Policy.

You will be advised by separate correspondence of the results of our

deliberations on this matter.

No response regarding this apparent violation

is required at this time.

In addition to the apparent violation being considered for escalated

enforcement, the report addresses a number of unresolved issues and

weaknesses.

We request you address each of these items.

After reviewing your

response, including your propos~d corrective actions and the results .of future

inspection, the NRC will determine whether further NRC enforcement action is

necessary to ensure compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790*of the-Commission's regulations, a copy of

this letter, the enclosures, and your response to this letter will be placed

in the NRC Public Document Room.

The response directed by this letter is not subject to the clearance

procedures of the Office of Management and Budget as required by the Paperwork

Reduction Act of 1980, PL 96-511.

We will gladly discuss any questions you have concerning this inspection.
