NRC INSPECTION REPORT NO. 50-255/93026(DRP)

This refers to the inspection conducted by Mr. E. R. Schweibinz of this office

from October 14 through November 3, 1993.

The inspection included a review of

activities authorized. for your Palisades Nuclear Generating Facility. At th~

conclusion of the inspection, the findings were discussed with those members

of your staff identified in the enclosed report (Enclosure 2). Additional

discussions were conducted by telephone on November 22, 1993. *

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, and interviews with personnel.

The purpose of the

inspection was to determine whether activities authorized by the license were

conducted safely and in accordance with NRC requirements.

Based on the results of this inspection, four apparent viola~ions were

identified and are being considered for escalated enforcement action in

accordance with the "General Statement of Policy and Procedure for NRC

Enforcement Actions" (Enforcement Policy), 10 CFR Part 2, Appendix C.

Accordingly, no Notice of Violation is presently being issued for these

inspection findings.

One of the apparent violations involved a violation of

Technical Specifications, Limiting Condition for Operation 3.3.l, 3.4.l and

3.0.3 because the reactor was critical and continued to operate at power with

the safeguards room cooler fans inoperable and incapable of performing their

design function.

This rendered ECCS and containment cooling equipment

inoperable.

Another apparent violation involved a violation of Technical

Specifications, Limiting Condition for Operation 3.17.1 because the

containment high pressure and containment high radiation actuation system

relays installed in 1990 were not capable of performing their intended safety

functions under certain design conditions.

The remaining two apparent

violations involved violations of 10 CFR 50, Appendix B, Criterion III because

inadequate design control measures applied to the change of setpoint for the

safeguard room fan coolers motor breaker thermal overloads, and because

containment high pressure and containment high radiation relays with nine or #'

more normally closed contacts were installed with an inadequately sized coil,

such that their operation under design conditions involving seismic events and

mjnimum-electrical voltage was not assured.

In addition, please be advised

that the number and characterization of apparent violations described in the

enclosed inspection report may change as a result of further NRC review.

An enforcement conference to discuss these apparent violations has been

scheduled for December 3, 1993.

The purposes of this conference are to

discuss the apparent violations, their causes and safety significance; to

provide you the opportunity to point out any errors in our inspection report;

and to provide an opportunity for you*to present your proposed corrective

actions.

In particular, we expect you to address whether safety systems

associated with both the safeguards room fan coolers and the containment high

pressure and containment high radiation actuation relays would have been able

to perform their intended safety functions, given the preexisting conditions.

In addition, this is an opportunity for you to provide any information

concerning your perspectives on 1) the severity of the violations, 2) the

application of the factors that the NRC considers when it determines the

amount of a civil penalty that may be assessed in accordance with Section

VI.B.2 of the Enforcement Policy, and 3) any other application of the

Enforcement Policy to this case, including the exercise of discretion in

accordance with Section VII.

You will be advised by separate correspondence

of the results of our deliberations on this matter.

No response regarding

these apparent violations is required at this time.

This enforcement conference will be open to public observation in accordance

with the Commission's trial program as discussed in the enclosed Federal

Register notice (Enclosure 3). Although not required, we encourage you to

provide your comments on how you believe holding this conference open to

public observation affected your presentation and your communications with the*

NRC.

The results of this inspection also showed that certain other of your

activities appeared to be in violation of NRC requirements, as specified in

the enclosed Notice of Violation (Enclosure 1).

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence.

After reviewing your response to the

Notice, the NRC will determine if additional enforcement action is necessary.

Also during this inspection, certain of your activities, pertaining to a

Regulatory Guide 1.97, pressurizer level indicator being powered from a

non-class IE power supply (paragraph 2.d), appeared to be in violation of NRC

requirements.

However, as described in the enclosed inspection report,- you

identified and corrected this violation. Therefore, the violation will not be
