  • TheprincipleobjectiveoftheLSNandanyLSN substituteistoprovideanelectronicdiscoverytool thatwillservetheneedsoftheparticipantsinthe YuccaMountainlicensingproceeding.
  • ThisisespeciallyimportanttotheStateofNevada.
  • Nevadawillneedtosupportanddefendover200 contentions,probablyunderstrictdeadlines,and NevadawillsufferthemostiftheLSNorLSN substituteperformspoorly.

LSNARPandDeterminationofUsers Needs

  • TheLSNARPwasestablishedundertheFederalAdvisoryCommittee Act(FACA)and,asrequiredbyFACA,operatesunderanNRC approvedCharterthatspecifiesLSNARPsobjectives.
  • LSNARPCharter:LSNARPsprimaryfocusistechnicalissues relatingtotheoperationandmaintenanceoftheLSNandcontinuing assessmentsastohowandwhethertheLSNisperformingits intendedfunctionandservingusersneeds.
  • Thereforedeterminingtheusersneedsiscritical.
  • Theusersneeds(especiallytheneedsofthenineteen participants)canonlybedeterminedthroughtheiractive participationintheadvisorycommitteeprocessandinsubsequent rulemaking.
  • Allnineteenparticipantsmustbeinvolved,especiallyatearlystages whencriteriaforarchitectureselectionaredevelopedand architectureoptionsareputforward.

LSNARP&CurrentConstrained Circumstances

  • Withtheproceedingsuspendedforoversixyears, prospectsforresumptionunclearatbest,andnonew federalfundingforpartiesandparticipantsinthe currentfiscalyear,itisnotreasonabletoexpectthe kindofparticipantinvolvementthatisrequired.
  • TheCommissionhasrecognizedthatparticipants fundinglimitationsmustbetakenintoaccountin decidinghowtomoveforward(CLI1308,78NRC219, 233(2013)).
  • Tomoveforwardwiththisadvisorycommitteeprocess allLSNARPmemberswillneedadequateresourcesso thattheycanparticipateeffectively,especiallyin formulatingcriteriaforarchitectureselectionandthen puttingoptionsforwardforfurtherconsideration.

NevadaExpectationforThisLSNARP Meeting

  • NevadaunderstandsthattheLSNARPChairDr.Bates,representativesof theAtomicSafetyandLicensingBoardPanel,andotherNRCstaff, are andwillinthefuturebeconstrainedbyCommissiondirectives.
  • Nevertheless,Nevadawishestostate,fortherecord,that,whileitis participatinginthisLSNARPmeeting,Nevadaobjectstoanyprocess wherebyaninadequatelyfundedLSNARPwouldbeaskedtoprovide finaladviceafteronlythisonemeeting.
  • Nevadasuggeststhattheproperdeliverablefromthismeetingcannot befinalopinionsandoptionstotheASLBP.
