TRANSFER OF PLANT OWNERSHIP (TAC NO. M72245}
By letter dated February 27, 1989, Consumers Power Company (CPC) requested that the Palisades operating license be amended to reflect the transfer of ownership of the Palisades Plant from CPC to Palisades Generating Company.
Revisions and additional information were provided in CPC letters dated April 6, 1989 and May 24, 1990, and in a meeting with the NRC staff on May 16, 1990.
Staff review of the license amendment request has been ongoing and additional information was requested in NRC letters dated March 23, and July 25, 1990.
The responses to those requests were provided in CPC letters dated April 20, 1990 and August 17, 1990, respectively.
By letter dated April 30, 1991, the NRC staff gave its conditional approval for the transfer of the plant ownership.
The approval was contingent on four license conditions to be incorporated into the Palisades license.
On June 12, 1992, the Michigan Public Service Commission denied Consumers Power Company's application for approval of its Power Purchase Agreement with the Palisades Generating Company.
As a result, it has not yet been decided what future action, if any, CPC will be taking.
It is also our understanding that the Federal Energy Regulatory Commission approval necessary to the transaction has not yet been issued and that it is not possible at this time to know when or if this approval will be forthcoming.
Significant delay in transferring ownership could change the information on which our review is based and could require further submittals.
We are, therefore, suspending review on the amendment request currently being conducted under Technical Assignment Control (TAC) Number M72245 and will close this TAC number for administrative purposes.
