consumers Power POW ERi Nii MICHlliAN'S PROGRESS Palisades Nuclear Plant: 27780 Blue Star Memorial Highway, Covert, Ml 49043 June 11, 1991 Nuclear Regulatory Commission Document Control Desk Washington, DC 20555 GB Slade General Manager DOCKET 50-255 - LICENSE DPR PALISADES PLANT - ENVIRONMENTAL PROTECTION PLAN (NON-RADIOLOGICAL)-CLARIFICATION OF REPORTING RELATED TO NPDES PERMITS Appendix B to Operating License No. DPR-20, Palisades Plant, section 3.2 states that "Changes and additions to the NPDES Permit or the State Certification shall be reported to the NRC within 30 days following the date the change is approved."
An internal audit recently identified that this 30 day reporting interval had not been met with one revision to the Palisades NPDES permit.
The results of our investigation has shown that once the State of Michigan approves a NPDES permit change or renewal, it may then take 30 days or more to issue the permit to Consumers Power Company, at which time the approval becomes effective for the Palisades Plant.
Therefore, in the future, we will be treating the approval date per Section 3.2 of Appendix B, as the date Consumers Power Company receives the revised permit from the State of Michigan.
Reporting the Palisades NPDES Permit changes or additions to the NRC will be made within 30 days after the permit is received from the State.
Section 3.2 of Appendix B also states that the NRC shall be notified within 30 days following the date that a permit or certification, in part or its entirety, is appealed or stayed by the State of Michigan.
While we have not had the occasion to request appeals or stays of permits or state certifications, we foresee that State action in these types of situations would be similar to the delay experiences that we've had with the NPDES permit.
Therefore, we also will be treating the date a stay is granted as the date Consumers Power Company receives the notice of State of Michigan action on the NPDES Permit.
We will then notify the NRC within 30 days after receipt of the stay from the State of Michigan
