ANNUAL EMERGENCY EXERCISE -

EXEMPTION OF STATE AND COUNTY PARTICIPATION Consumers Power Company has been notified by the Michigan Department of State Police (Attachment 1) that the State of Michigan and Van Buren, ALlegan and Berrien Counties will not be participating in the Palisades annual emergency exercise scheduled for August 21, 1984.

The State's decision is based on the Federal Emergency Management Agency's (FEMA) new rule 44 CFR 350 and instruc-tions received by FEMA (Attachment 2).

Information Notice No 84-05; Revision 1 dated March 28, 1984, stated, in part, that NRC licensees may only conform with the FEMA rule by specific exemption request no less than 60 days prior to the date of the licensee's annual exercise.

Accordingly, Consumers Power Company requests an exemption of county and state participation in the Palisades annual emergency exercise, August 21, 1984.

Attached for your information is correspondence to the State of Michigan from FEMA which documents adequate state and county participation in the 1983 Palisades exercise (Attachment 3) and correspondence (Attachment 4) to Consumers Power Company from the NRC concerning completion of FEMA's "350 Review Process" at Palisades.

Consumers Power Company will exercise goals and objectives to be stated in our "75-Day Letter" to Region III, to be submitted no later than June 7, 1984.

Biennial Frequency of REP Exercises The appiication of.FEMA' s Final Rule 1!4 CFR Part 350, dated September 28,

  • 1983, concerning Biennial Radiological Emergency Preparedness Exercises (350.9) should ~e construed as follows:

A State that exercised fully between the period October i, 1982, and the present, is eligible for exercising biennially.

A* local organization which has exercised fully bet\\*1een October 1, 1982, and the. present is eligible for exercising biennially.

The above is illustrated in the following examples.

p:-ample fl 1 The State of Ill:inois fully participated in an exe::>cise with the Byron Nuclear Power Station and Ogle County, D.linois, on Novembel" 15, 1983.

'fherefore, the State of Illinois is el1gible for exercising biennially.

Example fl 2 The State of Wisconsin* fully participated with the Kewaunee Nuclear Power Plant and Kewaunee and Manitowoc Counties, Wisconsin, on November 1, *1983.

Therefore, the State of Wisconsin is eligible for exercising biennially.

Example 41 3 Local jurisdictions that have fully participated j_n an REP exercise between October 1, 1982, and the present are eligible for exercising biennially. Eligibility is establi:3hed even though the State may not have fully participated.

Examples are:

Lake County 1 Illinois, and Kenosha County, Wisconsin, fully participated in the January 18, 1983, Zion exercise when the State of Illinois and Wisconsin did not.fully participate.. In this instance, Lake County, Illinois, and Kenosha County, Wisconsin, nre eligible for exercising biennially.

The Natj_onal Federal Emergency Management Agency has confirmed this understanding of the September 28, 1983, FEMA Final Rule. It is important the States and the local governments consider the above as part of their preparation for the January 12, 1984, meetfog at the Ramada Inn, O'Hare. *The Radiological Emergency Preparedness ExerciSe Schedule, as currently developed, will change as a result of the

new FEMA Rule.

Attachment A to this letter is a listing of State and loca;t.. jurisdictions that are eligible for exercising biennially.

Attachment B is a

veloping and improving your plans and operations procedures.

The report indicates the State of Michigan and the Counties of Allegan, Berrien, and Van Buren demonstrated a capability to protect the health and safety of the citizens and the property in the area at risk.

This report also cites certain areas that will require attention to correct and improve plans and implementing.procedures.

I.would appreciate your review of this document and response to it by indicating the corrective actions and the dates you intend to implement them, item by item, according to the format previously provided.

Specifically, your response should address Part IV of this report.

Please provide me with your plan for correcting the deficiencies noted in Part IV by October 28, 1983.
