Dear Judge Smith:
The purpose of this letter is to provide you with a report on the status of discovery and other prehearing matters in this proceeding pursuant to your memorandum and order of February 29, 1980.
Counsel for Consumers and the NRC Staff have discussed and agreed to the contents of this letter.
Consumers has provided to the Staff a report and other documentation which, in Consumers' view, have a bearing upon the period of time the isolation valves in question were open during operation.
The NRC Staff has informally requested that Consumers perform additional investigations and analyses.
Consumers is in the process of performing such investigations and analyses; The parties have agreed to pursue discovery matters which remain outstanding.
These matters include the deposition of Mr. Fred Leckie on February 9, 1981, and responses by Consumers to the NRC Staff's Third Round of Interrogatories.
The parties have also agreed to suspend further formal
.,.__,_ discovery until such time as it can be determined whether a settlement agreement can be reached.
