Dear Judge Smith:
The purpose of this letter is to.provide you with a report on the status of discovery and other prehearing matters in this proceeding, pursuant to your Memorandum and Order of February 29, 1986.
Counsel for the licensee and the NRC Staff have discussed and agreed on the contents of this letter.
On September 24, 1980, the Staff filed its responses to Consumers Second Round of Interrogatories dated August
.20th, 1980.
The Staff intends to file requests for admissions by Consumers within the next week.
Consumers is preparing its responses to the Staff's Second Round of Interrogatories directed at Consumers.
The Staff does not have any objection to permitting Consumers to file these responses on or before October 16th, 1980.
Upon receipt* of these responses the Staff will consider the need for further discovery and in particular the need for the taking of depositions of Consumers employees.
Similar~y,.Consumers is considering the need for depositions of those witnesses identified by the Staff as likely witnesses at the hearing.
