Enclosed for your information is the synopsis (redacted) of the Nuclear Regulatory Commission's (NRC) Office of Investigations (OI) completed report regarding an allegation of discrimination as a result of raising safety concerns.

The investigation did not substantiate allegations of discrimination in this case.

Based on the results of the investigation and our subsequent

review, we plan no further action with regard to this matter.

Office of investigations (OI), Region II (RII) Field Office initiated an investiaation of Alleaation No.

The alleger in this matter was employed as a

general foreman by Stone and Webster Engineering Corporation (SWEC),

a contractor to the Tennessee Valley Authority (TVA) at the TVA Browns Ferry Nuclear Plant (BFNP).

According to his March 30,

1993, complaint filed with the U.S. Department of Labor (00L),

Wage and Hour (W&H) Division, the alleger was discriminated and retaliated against by SWEC for raising safety concerns to his management about the adequacy of firewatch procedures employed by SWEC at BFNP

OI reviewed the DOL W&H inquiry, an investigation by the TVA Office of the Inspector General and the findings of a DOL Administrative Law Judge in this matter.

In each of these proceedings it was determined that the claimant's allegations were unsubstantiated.

It is concluded that the allegation that SWEC discriminated aaainst the alleger for enaaging in protected activity is not substantiated.
