PROPOSED IMPOSITION OF CIVIL PENALTY - $ 62,500 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $62,500 was signed yesterday and will be issued today to Consolidated Edison Company.
This action is based on violations involving the failure to follow procedures and the falsification of a record.
The base civil penalty was escalated by 50K for the licensee's failure to identify the issue and was partially mitigated (25%) for the licensee's corrective action.
The staff submitted this action which also included a Demand for Information, for the Commission's review in SECY 91-009 which has been approved by the Comission.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice February 12, 1991 Telephone Notification of Licensee February 12, 1991 The State of New York will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
