RESPONSE

TO DEVIATION This letter provides TVA's response to the deviation transmitted by letter from Bruce Wilson to Oliver D. Kingsley, Jr.

dated December 7,

1989.

The report cited TVA with a deviation for failure to notify NRC at the earliest possible time of TVA senior management changes as committed in TVA's Nuclear Performance, Plan (NPP)

Volume 1, Revision 6.

Enclosed is TVA's response to the deviation.

No new commitments are identified'n this submittal, As discussed in the enclosure, TVA believes. the original need for this requirement no longer exists and we request NRC approval for discontinuing the formal notification of senior management changes.

NRC INSPECTION REPORT NOS. 50-259/89-49, 50-260/89-49, AND 50-296/89-49 LETTER FROM BRUCE WILSON TO OLIVER D.

KINGSLEY, JR.

DATED DECEMBER 7, 1989 DEVIATION 259 260 296/89-49-02 NUREG-1232, Volume 1, Safety Evaluation Report on Tennessee Valley Authority:

Revised Corporate Nuclear Performance Plan, July 1987, stated that "TVA was requested to notify the NRC at least 30 days before making any permanent change in their organization or permanent replacement of senior managers."

The Revised Corporate Nuclear Performance

Plan, Volume I, Revision 6, states in Section III, A.l, that it is not always possible to notify the NRC at least thirty days prior to a permanent change in senior management but TVA will keep the NRC advised of changes at the earliest possible time.

Senior Managers include the Chairman, Nuclear Safety Review Board and the Manager of Nuclear Training.

Contrary to the above, on October 23,

1989, TVA appointed a new NSRB Chairman; and in early November 1989; a replacement was named for the departed Manager of Nuclear Training.

Both of these senior management changes were made without formal or informal notification of the NRC either before or within a reasonable time after the changes.

TVA's senior management changes without notification of the NRC at the earliest possible time are considered a

Deviation from NPP, Volume I commitments to the NRC.

RESPONSE

TO DEVIATION Reason For Deviation The reason for the deviation was a failure of TVA to implement a commitment made in an October 16, 1987 submittal from S.

A. White to James G. Keppler and subsequently included in Revision 6 to the Corporate Nuclear Performance Plan.

Corrective Ste s Which Have Been Taken On November 20,

1989, a letter was transmitted from O.

D. Kingsley, Jr, to Dennis M. Crutchfield informing NRC of changes in senior management and organization.

Among these changes were the replacements of the Nuclear Safety Review Board Chairman and the Manager of Nuclear Training.

In addition, this November 20, 1989 submittal provided an updated list of Nuclear Power Senior Managers.

When NRC requested, in their July 1987 Safety Evaluation Report, that they be notified before TVA made permanent changes in the organization or permanent replacement of senior managers, including Site Directors, many of the TVA senior managers were loaned employees.

Additionally, TVA was still in the process of implementing programmatic and organizational changes as committed in the revised Corporate Nuclear Performance

Plan, Volume l.

Since that time, significant changes have been made in the organization structure and TVA no longer has loaned senior managers.

TVA has also submitted to NRC the Nuclear Power Organization Description topical report for approval.

This topical report will be revised as necessary to reflect major organizational changes and at least annually in accordance with the requirements of 10 CFR 50.71.

The original need for notifying NRC of senior management and organization changes no longer exists, and with NRC approval, TVA will therefore begin to function as other utilities and discontinue the formal notification of these changes.
