Dear Senator 5chweiker:
By letter of October 24, 1979, you asked for our 'views on a letter to you dated October 16, 1979, from Robert P.
and Yita fl. Shively.
The letter deals with alleged limi'tations on public participation in the licensing pro-ceedings involving Pennsylvania Power 5 Light's Berwick nuclear generating facility, purportedly brought about by questions to participants in the proceedings concerning the basis of their concerns, and limitation on the free distribution of publications by the NRC.
Requests for information from other parties appearing in NRC proceedings is pgovided for in the discovery rules of the Commission (10 CFR 2.740).
These rules are desig~ed to prevent surprise at the hearing and also allow us to examine the concerns of the intervenors and ascertain their validity. If the intervenors do not haye the information sought on the basis of their,
- concerns, they could simply state that they have no information.
- However, to the extent they have information that has a, bearing on whether this
.facility should be licensed, it should be broUght forth in,response to these questions so it can be examined.
To help you better understand this matters we are enclosing the latest NRC Atomic Safety and Licensing Board order on discovery in this proceeding.
The new HRC policy in regard to the distribution of free documents to partici.-
pants in HRC proceedings is not a limitation.
As is seen in the attached announcement, also sent to you, the NRC is engaged in a trial program of printing an extra 200 copies. of its HUREf~ documents for distribution to participants ln iRC proceedings who request them.
There has been no attempt to cut off information to the public.
