Dear Senator Heinz:

In memorandum of October 18, 1979, you asked the Nuclear Regulatory Commission to comment on a letter to you of October 14, 1979, from James E. Gormley.

The letter deals with (1) a new NRC policy which allegedly results in restrictions on the distribution of NRC documents and the effect of that policy on inter-venors participating in the proceedings involving the licensing of the two nuclear steam generators at the Susquehanna Steam Electric Station in Berwick, Pennsylvania, and (2) requests for information from intervenors on their allegations in that licensing proceeding.

The new NRC policy in regard to the printing of NRC documents provides that an additional 200 copies of NRC publications are to be printed during a

trial period ending on March 1, 1979, so that they can be supplied to inter-venors and other participants in NRC proceedings such as those involving the Susquehanna station.

We enclose a copy of the NRC announcement of that policy.

As can be seen, the intent in printing 200 extra copies of the documents was to make more copies available to participants in NRC proceed-

ings, and not less copies.

The requests for information from the intervenors in the Susquehanna proceed-ing were made under the discovery rules of the Commission (10 CFR 2.740).

This information was needed to prevent surprise at the hearings, and so that the concerns of the intervenors could be ascertained and examined to see their validity.

The propounding of the questions did not require that the intervenors engage in any research to answer the questions.

If they did not know the answer to a question, they could simply state so.

However, to the extent they had further information which had a bearing on whether the Susquehanna facility should be licensed they should supply, that informa-tion so that their allegations can be seriously considered.

To help you better understand this matter we are also enclosing the latest NRC Atomic Safety and Licensing Board order on discovery in this proceeding.
