ECNP's petition sets forth nothing which war-rants a different outcome.

  • The Appeal Board did not consider ECNP's request to place a

Commissioner on the Atomic Safety and Licensing Board, deeming it beyond the Appeal Board's power and a matter for Commission determination.

ALAB-613, slip op. at 42, fn. 49.

ECNP has provided no justification for the extraordinary and unprecedented step of reconstituting the Licensing Board, particularly in a proceeding which has been underway for more than two years.
