Applicants respectfully submit that the Atomic Safety and Licensing Appeal Board has thoroughly analyzed and correctly disposed of the matters referred to it in the Commission's May 16, 1980 Order, CLI-80-17, ll NRC 678.* ECNP's petition sets forth nothing which war-rants a different outcome.

  • The Appeal Board did not consider ECNP's request to place a Commissioner on the Atomic Safety and Licensing Board, deeming it beyond the Appeal Board's power and a matter for Commission determination. ALAB-613, slip op. at 42, fn. 49. ECNP has provided no justification for the extraordinary and unprecedented step of reconstituting the Licensing Board, particularly in a proceeding which has been underway for more than two years.
