Our rirst and:ifth Amendment Rights are involved. The Citizens have sufficient research prepared to go directly to public bearings. In regards to the actual public hearings, the following preferences and recommendations are outlined for careful consideration by all parties: l) The city of Wilkes-terre, pennsylvania (the county seat of Luzerne County) be designated as the locality for the public hear1ngs; The PP&L Atomic Plant site 1s in Salem Townsh1p, Luzerne County. 2) The Federal Courthouse 1n Wilkes-3arre be reserved as the public hearing s1te; 'I 3) Witnesses for each intervening group should be allowed to present their separate test1mony and exhibits relat'ng to each category or contention submitted for the hearing agenda; 4) The corporate off1cers and managers who will be directly responsible for he superv1sion of the >+hL Atomic Plant should be ordered to appear in person and testify under oath, and subm1t to cross-examination under oath. (Surrogates should oe disallowed); 5) Local, State, Federal and Industry officials who will regulate and inspect all aspects of the fuel cycle pertaining to Permits.Ãos. CPPR-101 and CPPR-102 (Docket Nos. 50-587 and 50-588) I should be dir ected to testify also under similar gu1lel1nes. 6) Pursuant to the: reedom of Information Act, et al, the intervening parties should be promptly furnished, free of charge, one true certif1ed set of the complete ÃRC f1le, including: applications, correspondence, Ni?C staff reports, memorandums, safety and environmental studies and reports, legal documents, and any other pertinent government date relating to ?ermit Nos. CPPi?-101 snd CPPR-102; and Docket Nos. 50-$ 87 and 50-$ 88. (see post script for one exa pie); The Citizens believe that th1s recuest for public documents is reasonable, necessary end in the public interest. In conclusion, the Citizens respectfully reminds the NRC that he United States General Accounting Office recently conducted an investigative study of the NRC and publ1shed a critical report to the Congress entitled: The Nuclear Regulatory Commission Needs to A""ressivelv l-.'onitor And Indenendentlr =valuate Nuclear Powernlant Construct1on. This report points out defic1enc1es at the NRC in the pest, affecting, among other things, the public's right o be pro ec ed from nuclear dangers. Because of tbe potent1al enormous impacts on the human environment in tbe Commonwealth by the PAL Atomic Plant and the K<V transm1ssion to Allegheny =lectric, the C1tizens hereby petition the entire Congressional Delegation from Pennsylvania to closely monitor the dealings of the ÃRC prior to and during tbe hearings, in light of tbe GAO report, to be sure that tbe Constitutional Rights and the "right to know" of tbe 1nterveners and the1r witnesses are fully protected. In a word, no "Catch 22" bureaucratic or legal slight-of-band should enter into tbe proceedings. Of course, the Congressmen and their aides are invited to witness tbe public bearing, to be scheduled early next vear. The obligat1on to interpret government rules and regulations along Const'tutional 11nes to 1nsure that tbe publ1c-interest interveners're afforded full protection and due process of law lies squarely w1th the iXRC.
