Dear Hr Secretary:

In response to similar correspondence, each dated November 3, 1978, from a NRC lawyer.and another Washington lawyer standing-in f'r the PAL, tbe Citizens Against Nuclear Dangers (Citizens) offer the following observations and recommendatlons to tbe parties involved.

Tbe Citizens, in ita timely petitions filed with the NRC, clearly outlined some of its contentions.

The Citizens believe that they are relevant and ln-tbe public interest, in that they pertain primarily to issues of publio health and, safety; which we presume should also be a primary concern of'be NRC, in reviewing the Operating Perm1t Applications fot'. the PAL Berwick Atomic-Plant, under construction.

We do not precelve any merit ln the request to confer with the two attorneys referred to above.

The NRC staff la<<yer, ln fact, has already exhibited <<hat apoears to be blas ln this case.

Ãe, also, gather from their correspondence that they apparently do not truly r ecognlze our legitimate contentions.

So, we defer from taking part in a suggested pre-pre-hearing conference, lf only to avoid the slightest appearance of deal-making.

The Citizens urge tbe other lnterveners to do llkewlse.

Our First and Fifth Amendment Rights are involved.

The Clt1zens have sufflc1ent research prepared to go directly to public hearings.

We do, however, acknowledge that tbe other parties may need considerable time to prepare f'r the forthcoming oublic hearings.

Tbe Citizens will agree to such necessary delays on their

part, and we vill be ready when the other parties are..

Because of tbe potential enormous impacts on tbe human environment in the'Commonwealth by the PAL Atomic Plant and the UHV transmission to Allegheny =lectric, tbe Citizens hereby pet1tion the entire Congressional Delegation from Pennsylvania to closely mon1tor the dealings of tbe NRC prior to and during the hearings, in 11gbt of tbe GAO report, to be sure that tbe Constitutional Rights.and the "right to know" of the interveners and tbe1r w1tnesses are fully protected.

In a word, no "Catch 22" bureaucrat1c or 1'egal slight-of-band should enter into tbe proceedings.

Of course, tbe Congressmen and their aides are invited to witness the public hearing, to be scheduled early next year.

The obl1gation to interpret government rules and regulations along Constitut1onal lines to insure that tbe public-interest interveners're afforded full protection and due process of law lies squarely with tbe 8RC ~

Tbe Congress, for its part, should exert its power of overs1ght regarding the ÃRC in this csee

In regards to the actual public hearings, the following preferences and recommendations are outlined for careful cons1derat1on by all parties:

l)

The city of Milkes-narra, Pennsylvania (the county seat of Luzerne County) be des1gnated as the locality for the public hear1ngs; The PP&L Atom1c Plant s1te 1s 1n Salem Townsh1p, Luzerne County.

2)

The Federal Courthouse 1n 'rfilkes-narra be reserved as the public hearing s1te; 3)

Witnesses for each 1ntervening group should be allowed to present the1r seperate test1mony and exhib1ts relating to each category or content1on submitted for the hear1ng agenda; 4)

The corporate officers and managers who w111 be directly responsible for the supervls1on of the QbL Atomic plant should be ordered to appear in person and testify under oath, and submit to cross-examination under oath.

(Surrogates should be disallowed);

5)

Local, State, Federal and Industry off1cials who'ill regulate and inspect all aspects of the fuel cycle pertaining to Permits Nos.

CPPR-101 and CPPR-102 (Cocket Nos. 50-387 and 50-388) should be directed to testify also under similar guilellnes.

6)

Pursuant to the preedom of Information Act, et al, the intervening part1es should be promptly furn1shed, free of charge, one true cartif1ed set of the complete NRC file, 1ncluding:

appl1cations, correspondence, NRC s aff reports, memorandums, safety and env1ronmental studies and reports, legal documents, and any other pertinent government date relating to Permit Nos.

CPPR-101 and CPM-102; and, Docket Nos.

50-387 and 50-388.

(see post script for one example);

The Citizens believe that th1s request for public documents is reasonable, necessary snd in the public 1ntarest.

ln conclus1on, the C1t1zens respectfully reminds the NRC that he United States General Accounting Office recently conducted an 1nvestigative study of the NRC and published a critical report to the Congress entitled,:

The Nuclear Re latorv Commission Needs to A "ressivel Monitor And Indeaendentl

=valuate Nuclear Powerolant Construction.

This report po1nta out def1clencies at the NRC 1n the past, affecting, among other things, the public's right to be protected, from nuclear dangers.
