Withthisemail,theU.S.NuclearRegulatoryCommission(NRC)staffisprovidingresponsestotheNationalMarine FisheriesServices(NMFS)questionssubmittedtothestaffonDecember12,2017,relatedtotheWestinghouseElectric Company(WEC)ColumbiaFuelFabricationFacility(CFFF)proposedlicenserenewal(NMFSConsultationNo.SER2017 18839).TheNMFSsquestionswiththeNRCstaffsresponsesareattached.Ourresponseincludesreferencetoafigure ofthedischargepiping.However,thefigureisproprietaryandshouldremainnonpublic.Therefore,thatfigurewillbe sentunderseparateemailwithpasswordprotection.

TheNRCstaffsubmittedaBiologicalEvaluationtotheNMFSonAugust15,2017,thatcontainedtheNRCstaffsanalysis oftheimpactstotheshortnosesturgeonwithintheCongareeRiverasaresultoftheproposedcontinuedoperationof theCFFFforanadditionalfortyyears.TheprimarypathwayforCFFFoperationstoaffecttheshortnosesturgeonis throughthedischargeofliquideffluentdirectlyintotheCongareeRiver,3.5milesdownstreamoftheCFFF property.CFFFliquideffluentisacombinedstreamoftreatedsanitarywasteandprocesswastesandispermitted throughtheSouthCarolinaDepartmentofHealthandEnvironmentalControl(SCDHEC)undertheconditionsofNational PollutantDischargeEliminationSystem(NPDES)PermitNo.SC0001848.

WECreleasesstormwaterintoupperSunsetLakethroughonecombinedoutfallthatispermittedthroughanSCDHEC issuedIndustrialStormWaterGeneralNPDESPermit(No.SCR000000).StormwaterfromtheCFFFsitedoesnotdirectly flowintotheCongareeRiver,andtherefore,potentialeffectstoriverwaterqualityareminimal.

AlthoughgroundwatercontaminationhasbeendetectedattheCFFFsite,itiscontainedwithinthesiteboundaryandis expectedtoremainwithinthatboundaryfortheforeseeablefuture.WECmaintainsanactiveenvironmental monitoringprograminaccordancewithSCDHECandNRCrequirements.ThemonitoringrequiredaspartoftheNRC licenseincludesfishandriverwatersampling.Ifinthefuture,monitoringtrendsindicatethatcontaminationis increasingormovingoffsite,theSCDHECcouldrequirecorrectiveactionsoradditionalremedialmeasuresinorderto ensurethatenvironmentalimpactsareminimized.

BasedonthestaffsBiologicalEvaluationandtheaboveconsiderations,theNRCstaffhasdeterminedthatcontinued operationoftheCFFFunderthetermsofarenewedlicensemayaffect,butisnotlikelytoadverselyaffecttheshortnose sturgeon.TheNRChasprovidedsupplementalinformation,includingtheenclosedresponsesthatfurthersupportsthis determination.Additionally,asindicatedintheNRCstaffsresponsestotheNMFSsOctober12,2017,requestsfor additionalinformation,theNRChasmadeanoeffectdeterminationfortheAtlanticsturgeonanditscriticalhabitat becauseneitherthespeciesnoritscriticalhabitatoccurintheactionarea.

TheNRCstaffhasprovidedtotheNMFSitsAugust15,2018,BiologicalEvaluation;responsestotheNMFSsSeptember 22,2017,October12,2017,andDecember12,2017,requestsforadditionalinformation;copiesofWECs EnvironmentalReport;copiesoftheNPDESpermitandpermitrationale;aswellasvariousfiguresandotherrelevant information.TheNRCstaffbelievesthisinformationissufficienttoallowNMFStocompleteitsreviewoftheproposed CFFFlicenserenewal.Therefore,theNRCrespectfullyrequeststhattheSt.PetersburgNMFSfieldofficeprovidetheir

2 concurrenceontheNRCsnotlikelytoadverselyaffectdeterminationforshortnosesturgeonwithin30daysofthe receiptofthisemail.
