SUMMARY

OF DECEMBER 13, 2017, PUBLIC MEETING TO DISCUSS POSSIBLE CHANGES TO PHYSICAL SECURITY REQUIREMENTS FOR ADVANCED REACTOR DESIGNS On December 13, 2017, the U.S. Nuclear Regulatory Commission (NRC) held a Category 2 public meeting with various stakeholders to discuss possible changes to physical security requirements for advanced reactor designs (Agencywide Documents Access and Management System [ADAMS] Accession No. ML17334A212). Enclosure 1 contains a list of meeting attendees and participants who joined via webinar. The slides and meeting handouts are available in ADAMS Accession No. ML17354A961.

The NRC staff summarized the document Draft White Paper on Potential Changes to Physical Security Requirements for Small Modular and Advanced Reactors - Supporting Public Meeting of December 13, 2017 (ADAMS Accession No. ML17333A524). The primary purpose of the draft white paper is to support interactions with stakeholders during the development of a Commission paper on the topic of possible changes to security requirements for light-water small modular reactors and non-light water reactors. The draft white paper and NRC slide presentation outlined the following four options:

1) No change / Status Quo;
2) Address possible requests for alternatives via guidance;
3) Limited scope rulemaking to address what would otherwise be likely requests for alternatives; and
4) Broader based rulmaking to more fully reflect attributes of advanced reactors.

The NRC staff summarized each option and supported stakeholder discussions (see slides under ADAMS Accession No. ML17354A961). Dr. Edwin Lyman, of the U.S. Union of Concerned Scientists, offered a preference for Option 1 stating that: (1) there is no evidence that the number of applications for advanced reactors warrant a rulemaking; (2) advanced reactor technologies remain unproven; and (3) case-by-case assessments are more appropriate given the uncertainties. Representatives from the Nuclear Energy Institute, NuScale Power, and the Tennessee Valley Authority, preferred Option 3-stating that a limited scope rulemaking was needed to reduce regulatory uncertainties and to more fully support the goal of addressing security issues within the design process. The industry representatives are giving additional thought to whether they will suggest specific changes to regulations for Option 3 within the Commission paper (e.g., the requirements for armed responders in Section 73.55 of Title 10 of the Code of Federal Regulations) or, as described in the draft white paper, leave the specifics of a limited scope rulemaking, if pursued, until after the Commission decision. The staff invited additional feedback on this or other topics from any stakeholders participating in the meeting/webinar. It was generally agreed that additional meetings or interactions were not needed to support the NRC staffs completion of the Commission paper.
